Acknowledgements

1. We acknowledge the importance of protecting the privacy and rights of subscribers in respect of their Personal Information.
2. Your rights to privacy as well as the requirements relating to collection, management and disclosure of your Personal Information are set out under the Privacy Act 1988 (Cth) (hereinafter referred to as the Act). This Privacy Policy is governed under the Act, and is bound by all provisions therein.
3. The Act sets out a definition of “Personal Information”. This definition of the phrase is to be used hereinafter in this Privacy Policy. This definition generally includes any information that can be used to identify you personally; such information may include your name, occupation, address, telephone number or email address. 4. Make it Fit with Nikki may make changes to this Privacy Policy from time to time for any reason. Any changes will made available in an updated Privacy Policy in the same location where our Privacy Policy is typically found, and notifications of such changes will be places on our products and services for a reassemble time following the changes. This policy was last updated on 26 May 2023.
5. By continuing to use or access Make it Fit with Nikki, you agree that you have read and agree to this Privacy Policy, and acknowledge that you have been notified of the matters herein.

Information we may collect

1. We may collect any Personal Information that is reasonably required to provide and run our products and services. This may include:
   1. your first name, last name, phone number and email addresses;
   2. your date of birth, gender, age, height, weight;
   3. your instagram handle, are you pregnant or not, activity level;
   4. your food choices(breakfast, lunch and dinner), goal weight, or diet history; 
   5. fitness progress picture(front, back and side images)  every week for your reference and history;
   6. any Internet Protocol (IP) addresses, Unique Device Identifiers (UDIDs) and other unique identifiers in specific circumstances;
   7. details of products and services you have either enquired about or purchased from Make it Fit with Nikki; or
   8. Any other information relating to you and provided by you either directly or indirectly to us.
2. We may also collect anonymous information on usage of our products and services. This data is used to evaluate products and services that we offer, and to improve the content that is we produce.
3. Make it Fit with Nikki may also utilize cookies (an online tracking technology) to recognize your browser or device each time it interacts with us. This information is used for optimization of our products and services and to improve your experience whilst using or accessing Make it Fit with Nikki.
4. Websites/applications generally transfer information from cookies to a device’s hard disk for the purpose of record keeping. Browsers and devices are usually set to accept standard tracking technologies like cookies. These tracking technologies do not personally identify you, but do identify your browser or device. If you would prefer not to receive cookies, your browser or device can be adjusted to refuse them.
5. Personal Information is collected directly from you unless it is unreasonable or impracticable to do so. If you indirectly provide Personal Information to us, whether purposely or otherwise, this information may be collected and stored with the rest of your Personal Information.

   1. your accessing and use of Make it Fit with Nikki;
   2. your provision of information to become a subscriber;
   3. conversations between you and Make it Fit with Nikki admin or representatives;
   4. your purchases from Make it Fit with Nikki;
   5. your enquiries for further information on Make it Fit with Nikki products or services;
   6. participation in surveys and other research conducted by Make it Fit with Nikki;
   7. entering of promotions, sweepstakes, or contests hosted by Make it Fit with Nikki;
   8. subscribing to any mailing list, or any other group created by Make it Fit with Nikki; or
   9. any other means which results in you directly or indirectly providing information to Make it Fit with Nikki. 
7. Information from third parties such as credit reporting agencies, banks, law enforcement agencies, and other government agencies may also be collected.
8. If you do not provide us with the Personal Information described above, the following instances may happen:
   1. you may not be able to access part, or all, of certain products or services provided by Make it Fit with Nikki; 
   2. you may not be able to receive specific information about Make it Fit with Nikki products and services; or
   3. you may be unable to fully experience or access Make it Fit with Nikki products and services that rely on the provision of such information.
   4. If you have accidently provided, or we have otherwise obtained, any incorrect Personal Information about you, please contact us as soon as possible.
9. Upon being notified of any incorrect or inaccurate information, we will Endeavour to correct our records and minimize any damage or misinformation resulting from the error.
10. Notwithstanding the above, we are in no way liable for any incorrect or inaccurate information provided to or collect by us, and will not be held liable for any harm or damage in any way whatsoever associated with this incorrect or inaccurate information.

Use and Dissemination of your Personal Information

1. Any Personal Information stored by us is stored in a secure online/physical location and we take all reasonable precautions to ensure this location is not compromised.
2. We may disclose or disseminate your personal information where we are legally or ethically obligated to, where it is commercially viable to or otherwise where we believe it is of benefit of us or to disclose or disseminate such information.
3. Whilst in no way limiting the above, entities and persons who we may disclose or disseminate your personal information include:
   1. related Corporate Bodies;
   2. our employees, contractors or service providers for the purposes;
   3. IT services including systems administrators, web hosting providers, mailing houses, payment processors, data entry service providers and electronic network administrators;
   4. professional advisors (eg lawyers, accountants and business advisors);
   5. third-parties and suppliers that we have commercial relationships with;
   6. government and official entities and departments; and
   7. any other person or entity that may reasonably benefit from or require the use of your personal information.
4. Whilst in no way limiting the above, we may disclose or disseminate your personal information for purposes including:

   2. to create and run our products and services;
   3. business, marketing and other related purposes;
   4. legal or business disputes or negotiations;
   5. with your express consent; and
   6. Any other reasonable or required purpose.
5. From time to time direct marketing communications and information about our products and services that you may have an interest in, may be sent to you.
6. These marketing communications may be sent via mail, SMS, social media, fax and/or email and in accordance with applicable laws and your preferences. We will Endeavour to utilize your preferred communication method where you have indicated it, whenever it is practical to do so.
7. Links to any third-party websites or applications on our products or services are provided as a convenience to you and are in no way related to us. Using these links will result in you leaving the Make it Fit with Nikki.
8. We hold no responsibility for any third party websites or applications, nor their content or usage of your Personal Information
9. Whilst we take utmost care to ensure the entities that we may disclose or disseminate your Personal Information are safe and reliable, we offer no guarantee as to the safety and reliability of any other entity, and will not be held liable for any use of your Personal Information by any entities other than Make it Fit with Nikki.
10. Where reasonably practical or required, we may ask you for your express written consent for us to disclose or disseminate your Personal Information.
11. Whilst we strive to obtain consent at all times, this may not always be possible, and by using Make it Fit with Nikki you agree to this Privacy Policy and accept that we are not required to obtain your consent to disclose or disseminate your Personal Information.
12. Notwithstanding the above, there are some circumstances where we are required by the Act, or other legislation, to expressly obtain your consent before disclosing or disseminating your Personal Information. In these circumstances, we will always obtain your express written consent before disclosing or disseminating your Personal Information.

Breach of Privacy
 

1. We take any alleged or potential privacy breaches very seriously. Please notify ours Privacy Officer (below) as soon as possible if you do not believe your Personal Information is completely secure.
2. In the event that you believe your privacy has been breached, please contact our Privacy Officer providing details of the incident so that it can be investigated.
3. Such an investigation will involve all practical steps for determination, assessment, resolution and prevention of any alleged or actual privacy breach.
4. Following such an investigation, if any adverse findings are made, we will conduct appropriate remedial processes as required by the Act or otherwise assessed by us.

2. All requests, queries or complaints will be treated confidentially, and you will be contacted by a representative within a reasonable time after receipt of your request, queries or complaint to discuss your concerns and options for resolution.
3. We will Endeavour to resolve any complaint in a timely and appropriate fashion.

1. If, following an investigation by us of your complaint, you are still unsatisfied with our conduct or the status of your Privacy; you are entitled to further your complaint to the Office of the Australian Information Commissioner (OAIC).
2. Before you take any complaint or matter to the OAIC, you must let us know of the matter and await our investigation into the same.
